1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of alphaeagleroofing.com (the "Site") and any preliminary communications between you and Alpha Eagle Roofing ("Alpha Eagle," "we," "us," or "our") that precede a signed, written home-improvement contract. By accessing the Site, submitting a lead form, calling, texting, emailing, or booking an estimate, you agree to these Terms. If you do not agree, do not use the Site.

These Terms apply to the website and pre-contract communications only. The terms of any work we perform for you are governed exclusively by a separately signed written home-improvement contract, which prevails over these Terms to the extent of any conflict.

2. Contractor license notice (Cal. Bus. & Prof. Code § 7030)

As required by California Business and Professions Code section 7030:

Contractors are required by law to be licensed and regulated by the Contractors State License Board which has jurisdiction to investigate complaints against contractors if a complaint regarding a patent act or omission is filed within four years of the date of the alleged violation. A complaint regarding a latent act or omission pertaining to structural defects must be filed within 10 years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, California 95826.

Alpha Eagle Roofing holds California CSLB License #1148511, classification C-39 (Roofing Contractor). License status may be verified at cslb.ca.gov.

3. Description of services

Alpha Eagle Roofing provides residential and commercial roofing services — including roof inspection, repair, replacement, installation, gutter installation, skylight installation, and 24/7 emergency roofing response — to property owners in the San Francisco Bay Area. The Site allows you to learn about those services, request a free no-obligation written estimate, and book an inspection appointment through our online scheduling partner.

4. Eligibility & service area

You must be at least 18 years old and authorized to enter into a binding agreement on behalf of the property where work would be performed. Our service area is limited to the six-county San Francisco Bay Area (San Francisco, San Mateo, Alameda, Contra Costa, Marin, and Santa Clara counties). We may decline to provide services outside that area or where we determine, in our sole discretion, that we are not the appropriate contractor for the work.

5. Estimates & pricing

Estimates are written, itemized, and provided without obligation. An estimate is a good-faith projection of price based on a visual inspection and the information you provide. It does not become a binding contract until both parties sign a written home-improvement contract that complies with Cal. Bus. & Prof. Code § 7159. Pricing in an estimate is valid for the period stated on the estimate (typically 30 days) and may be revised if hidden conditions are discovered after work begins (e.g., concealed dry-rot or substrate damage), in which case any change must be documented in a written change order signed by both parties before the additional work proceeds.

6. Written home-improvement contracts (Cal. Bus. & Prof. Code §§ 7159, 7159.5)

All home-improvement work in California exceeding $500 in combined labor and materials requires a written contract signed before work begins. Our written contract includes, at minimum:

• Our name, address, and CSLB license number;
• A detailed description of the work to be performed and the materials to be used;
• The total contract price and the payment schedule;
• The approximate start and completion dates;
• Notice of the three-day right to cancel and the mechanic's lien notice required by California law;
• Down-payment limit: in compliance with § 7159.5, the down payment will not exceed the lesser of $1,000 or ten percent (10%) of the contract price; progress payments will not exceed the value of the work performed and materials delivered.

7. Three-day right to cancel (Cal. Bus. & Prof. Code § 7159, 16 C.F.R. § 429)

You have the right to cancel a written home-improvement contract for any reason by midnight of the third business day after you sign it. If the contract was signed as a result of a home solicitation (e.g., at your home rather than at our office), the cancellation notice and the right are presented to you in the contract itself in compliance with California's home-solicitation laws. Cancellation must be in writing and may be delivered to the address on the contract by personal delivery, U.S. mail, email, or other means that produces a record of receipt. Persons aged 65 or older have an extended cancellation right in declared-emergency contracts under § 7159 — see your written contract for the applicable timing.

8. Mechanic's lien notice (Cal. Civ. Code §§ 8200–8216)

Under California law, anyone who helps to improve your property — including contractors, subcontractors, and material suppliers — has the right to record a mechanic's lien against your property if they are not paid. A mechanic's lien is a claim made against your property by an unpaid contractor, subcontractor, laborer, or supplier, recorded with the county recorder where the property is located.

To preserve their lien rights, subcontractors and suppliers we engage must serve you with a Preliminary Notice within 20 days of first furnishing labor or materials. Receiving a preliminary notice does not mean you are being charged extra or that there is anything wrong with your project — it is a notice required by California Civil Code § 8200. To protect yourself, you may, before paying the prime contractor, ask for an unconditional waiver and release signed by every person who has served you with a preliminary notice. (Cal. Civ. Code §§ 8132–8138.)

The full statutory notice will be included with every signed home-improvement contract that meets the $500 threshold.

9. Communications & SMS consent (47 U.S.C. § 227 — TCPA)

When you provide your telephone number on the Site, by signing a contract, or in any other communication with us, you consent to receive non-marketing, transactional, and service-related communications from Alpha Eagle Roofing — including telephone calls, voicemails, text messages, and emails — relating to your inquiry, estimate, project, or account. We do not place automated marketing calls or send marketing text messages. Standard message and data rates may apply. Reply STOP to opt out of text messages at any time; reply HELP for help. Consent to receive communications is not a condition of any purchase. Communications about the Site itself (e.g., privacy policy updates) will be sent only when reasonably necessary.

10. Website content & intellectual property

The Site, including its design, layout, text, graphics, photographs, videos, logos, source code, and the "Alpha Eagle Roofing" name, is the exclusive property of Alpha Eagle Roofing or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. You may view and print Site content for your personal, non-commercial reference. You may not copy, reproduce, republish, distribute, modify, scrape, or create derivative works of any Site content without our prior written consent, except as expressly permitted by applicable law.

11. Reviews & testimonials

Reviews and testimonials displayed on the Site are submitted by actual customers and have not been edited for substance. We may quote, paraphrase, or display public reviews you have submitted on third-party platforms (Google, Yelp, Nextdoor) consistent with those platforms' terms of service and your stated preferences. If you would like a review removed from the Site, contact us at the address in Section 20 and we will honor your request within 30 days.

12. Acceptable use

You agree not to: (a) use the Site for any unlawful purpose; (b) interfere with the Site's operation, including by introducing viruses, denial-of-service attacks, or automated scraping that imposes an unreasonable burden on our infrastructure; (c) misrepresent your identity in any form submission; (d) submit lead-form information for any property or person you do not have authority to represent; (e) attempt to gain unauthorized access to any portion of the Site.

13. Third-party services

The Site uses, links to, or embeds third-party services — including our scheduling partner Jobber, our project-photo platform CompanyCam, Google Maps, Google Analytics, and review platforms. Your interactions with those services are governed by the respective third party's terms and privacy policies. We are not responsible for the content, practices, or availability of any third party.

14. Disclaimers

The Site and its content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties — express, implied, statutory, or otherwise — including merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and freedom from interruption or error.

Information on the Site is general in nature and is not a substitute for a professional, on-site roofing inspection. Photographs and project examples reflect work that has been completed; results on your specific property may vary. The Site does not provide legal, financial, or insurance advice; consult a qualified professional for advice specific to your situation.

The disclaimers in this Section 14 do not limit any rights or warranties that may not be excluded under California law. Nothing in these Terms limits your rights under California consumer-protection statutes or the express written warranties provided with our roofing services.

15. Limitation of liability

To the maximum extent permitted by California law, Alpha Eagle Roofing and its owners, officers, employees, agents, and subcontractors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or loss of goodwill, arising out of or relating to your use of the Site, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or relating to the Site (excluding signed home-improvement contracts) will not exceed one hundred U.S. dollars ($100). Nothing in this Section 15 limits liability that cannot be limited by law, including liability for personal injury caused by negligence or willful misconduct on a job site governed by a signed contract.

16. Indemnification

You agree to defend, indemnify, and hold harmless Alpha Eagle Roofing and its owners, officers, employees, agents, and subcontractors from and against any third-party claims arising out of (a) your breach of these Terms, (b) your misuse of the Site, or (c) your violation of any law or the rights of any third party.

17. Dispute resolution & governing law

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to any binding arbitration provision in a signed home-improvement contract, any action or proceeding arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in San Francisco County, California, and you and Alpha Eagle Roofing each consent to the personal jurisdiction and venue of those courts.

Before initiating any formal proceeding regarding a Site-related dispute, the parties agree to first attempt to resolve the dispute in good faith through informal negotiation by contacting legal@alphaeagleroofing.com with a written description of the issue and the relief sought.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. Your continued use of the Site after a change constitutes acceptance of the revised Terms. If a change is material, we will provide additional notice through the Site or by email.
